Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Klein Soundworks website and any audio software, plug-ins, presets, documentation and related materials we sell or make available (together, the “Products”). By purchasing, downloading or using a Product, you agree to these Terms. If you do not agree, do not use the Products.

1. Who we are

Klein Soundworks (“we”, “us”, “our”) is the provider of the Products. You can reach us at kleinsoundworks@gmail.com.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a binding contract to purchase and use the Products.

3. Your licence

When you buy a Product, we grant you a personal, worldwide, non-exclusive, lifetime licence to install and use it, subject to these Terms. Unless stated otherwise on the Product page:

  • You may install and activate the Product on up to three (3) machines that you own or control.
  • The licence is for your own music-production use, whether personal or commercial (your finished audio productions are yours).
  • Free updates within the licensed major version are included.

4. What you may not do

You may not, and may not allow others to:

  • Resell, rent, lend, sublicense, or redistribute the Product or your licence key, except as expressly permitted;
  • Copy, share, or publish the installer or licence key publicly;
  • Reverse engineer, decompile, or disassemble the Product, except to the extent this restriction is prohibited by applicable law;
  • Remove or alter any copyright, trademark, or proprietary notices;
  • Use the Product to develop a competing product.

5. Orders, pricing and payment

Prices are shown on the Product pages and may change at any time, but changes do not affect orders already placed. Payment is processed securely by our payment providers through Shopify; we do not store your full card details. All prices are shown in the displayed currency and may be exclusive of applicable taxes, which are added at checkout where required.

6. Delivery

The Products are digital goods delivered electronically. After a successful purchase you receive access to the download and a licence key by email, typically immediately. It is your responsibility to provide a correct email address and to keep your licence key safe.

7. Trials

Where a free trial is offered, it is provided “as is” for evaluation only and may be time-limited or feature-limited. Trials may not be used in commercial releases beyond the trial’s stated terms.

8. Refunds and right of withdrawal

Because the Products are digital goods delivered immediately, and to the extent permitted by law, your statutory right of withdrawal ends once the download begins with your consent. Our voluntary refund practice is described in our Refund Policy. Nothing in these Terms limits any non-waivable consumer rights you have under the law of your country of residence.

9. Intellectual property

The Products, including all code, designs, presets, artwork, and documentation, are owned by Klein Soundworks or its licensors and are protected by copyright and other laws. Except for the licence granted above, no rights are transferred to you.

10. Updates and availability

We may release updates, and we may change, suspend, or discontinue any Product or part of the website at any time. We are not obligated to provide updates or continued support for any particular version.

11. Warranty disclaimer

To the maximum extent permitted by law, the Products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Products will be uninterrupted, error-free, or compatible with every system or host. This does not exclude warranties that cannot be excluded under applicable consumer law.

12. Limitation of liability

To the maximum extent permitted by law, Klein Soundworks will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or projects, arising from your use of or inability to use the Products. Where liability cannot be excluded, our total liability is limited to the amount you paid for the Product giving rise to the claim.

13. Termination

Your licence ends automatically if you materially breach these Terms. On termination you must stop using and delete all copies of the Product. Sections that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules, and the competent courts of the Netherlands have jurisdiction, unless mandatory consumer law in your country of residence provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the current version. Continued use of the Products after changes take effect means you accept the updated Terms.

Privacy Policy

This Privacy Policy explains how Klein Soundworks collects, uses, and protects your personal data when you visit our website or buy our Products. We act as the data controller for this processing. If you are in the EU/EEA or UK, we process your data in line with the GDPR.

1. Data we collect

  • Order & account data — name, email address, billing/country details, and purchase history, so we can deliver your Product and licence key.
  • Payment data — handled by our payment providers via Shopify. We receive confirmation and limited details (e.g. last four digits), not your full card number.
  • Communications — messages you send us (e.g. support requests) and, if you opt in, your newsletter subscription.
  • Usage & device data — cookies and similar technologies collect information such as IP address, browser, pages viewed, and referring links, to run and improve the site.

2. How and why we use it

  • To process orders, deliver downloads and licence keys, and provide support — performance of our contract with you.
  • To send marketing emails where you have opted in — your consent, which you can withdraw at any time.
  • To secure the site, prevent fraud, keep records, and comply with legal obligations — our legitimate interests and legal duties.
  • To understand and improve how the site is used — our legitimate interests, or your consent where required.

3. Who we share it with

We share personal data only with service providers that help us operate, acting on our instructions:

  • Shopify — our e-commerce and hosting platform;
  • Payment providers — to process your payment securely;
  • Email & marketing tools (e.g. Omnisend) — to send transactional and, where you opted in, marketing messages;
  • Download hosting — to deliver installers and files.

We do not sell your personal data. We may disclose data where required by law or to protect our rights.

4. International transfers

Some providers may process data outside your country, including outside the EU/EEA. Where they do, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses.

5. How long we keep it

We keep order and invoicing data for as long as needed to provide the Products and to meet legal, tax, and accounting requirements. Marketing data is kept until you unsubscribe or withdraw consent.

6. Your rights

Subject to applicable law, you have the right to access, correct, delete, or receive a copy of your personal data, to restrict or object to certain processing, and to withdraw consent at any time. To exercise any of these, email kleinsoundworks@gmail.com. You also have the right to complain to your local data protection authority.

7. Cookies

We use essential cookies to run the store (e.g. your cart) and, with your consent where required, analytics and marketing cookies. You can manage cookies through your browser settings; blocking some cookies may affect how the site works.

8. Security

We use appropriate technical and organisational measures to protect your data. No method of transmission or storage is completely secure, but we work to safeguard your information and to notify you and the authorities of any breach where the law requires.

9. Children

Our Products are not directed to children, and we do not knowingly collect personal data from anyone under 16. If you believe a child has provided us data, contact us and we will delete it.

10. Changes and contact

We may update this Privacy Policy from time to time; the “Last updated” date above reflects the current version. For any privacy question or request, contact us at kleinsoundworks@gmail.com.
